You can submit a DMCA but really, many people borrow content and there's nothing you can do. In some cases, it goes down as syndication, which is good if there is a link back to your site but in many cases, it's best to promote the hell out of the content, rank it #1 and then the other site will show Google that it is copying content. If there is no link then ask for one from the site. If they deny you, then send the DMCA.
I've tested this with duplicate content and I promoted it harder than the original content and I'm ranking #1 for many keywords. It's not ethical but it was a test and it's making money. As a content writer, I needed to do this test to see if me job is in jeopardy, and it is (in my mind). That's why I'm focusing on building my own sites. Unique content is always preferred for sites but it's still possible to use dupe. It's a torrid time as a writer, though, I feel your pain.
