Yup You are Right, But Before that You should talk to Webmaster to remove the link from his site. if he doesn't then USE the below TOOL

If you want to have your link removed from someone else's website, it's best that you contact the site's webmaster. If you don't get any reply or if they refuse to take the link down, I suggest you use the Google Disavow Tool instead. However, Big G doesn't guarantee that it will honor all your requests to disassociate with a website. Do your best to get the webmaster to take that link down and use the disavow tool only as a last recourse.
